MEMBER TERMS AND CONDITIONS

Welcome to Sum1 Loans. These terms and conditions regulate the legal relationship between Sum1 Investments Proprietary Limited ("Sum1") and you, the Member, relating to the use of our website and services. By registering and signing up, you hereby agree to be bound by these terms and conditions and our privacy policy. Please read these terms closely to ensure you understand each part before using our services.

1. User Registration and Account Security

To access our loan application services, you must first register by filling out and submitting the "sign-up" form. You agree to:

• Provide information that is true, accurate, and not misleading in any material respect.
• Maintain the confidentiality of your password. You are fully responsible for all interactions with the service that occur in connection with your password or username.
• Immediately notify Sum1 of any unauthorized use of your password or username or any other breach of security related to your account.
• Not use a username or email address that is already in use, impersonates another person, violates the intellectual property of another, or is offensive.

2. Loan Application Process

Our platform facilitates the application for business loans. As part of the application, you will be required to create a business profile and submit various documents.

• You warrant that all information disclosed by you to Sum1 is true, accurate, and not misleading in any material respect.
• You may be required to upload documents such as founder identification, CIPC registration, bank statements (up to 6 months), financial statements, proof of address, and tax compliance information.
• You are solely responsible for the accuracy and legality of all information and documents you submit. Submitting false, misleading, or fraudulent information may lead to the suspension or termination of your access.

3. Data Privacy and Security

We are committed to protecting your privacy. Any and all information supplied to Sum1 by you shall be kept confidential by Sum1 and its investors or funding partners.

• You acknowledge that your personal and business data is handled securely to protect your privacy.
• By using our services, you consent to our use of your data. However, Sum1 shall be entitled with unfettered discretion to disclose any information known to it, or to produce any documents relating to you, if bound by law to do so.

4. User Conduct and Responsibilities

You agree not to use the service for any purpose that is prohibited by these terms and conditions. You are responsible for all of your activity in connection with the services.

• You shall not permit any third party to take any action or upload or submit content that you know to be false, misleading, fraudulent, or inaccurate.
• You shall not decipher, decompile, disassemble, reverse engineer, or otherwise attempt to derive any source code of any part of the service.
• You shall not use any device, software, or routine to interfere or attempt to interfere with the proper working of the service or any transaction being conducted on it.

5. Intellectual Property

The contents of the service, including any material, information, data, software, icons, text, graphics, images, trade names, logos, and trademarks, are the property of Sum1. You will not under any circumstances acquire any right, title, or interest in or to the service or its contents. Any use, distribution, or reproduction of the content is prohibited unless expressly authorized.

6. Limitation of Liability

This service and its content are provided "as is" and without any representation or warranty whatsoever. In the event that an unforeseen situation occurs, such as a technical failure or circumstance beyond our control, Sum1 shall not be held liable for losses and damages. Sum1 does not accept any responsibility for any errors or omissions on this service or its content.

7. Amendments to Terms

We reserve the right, at our sole discretion, to modify or replace any of these terms and conditions, or change, suspend, or discontinue the service at any time by posting a notice on the site or by sending you a notice via email. It is your responsibility to check these terms and conditions periodically for changes. Your continued use of the service following the notification of any changes constitutes acceptance of those changes.

These terms and conditions will in all respects be governed by and construed under the laws of the Republic of South Africa.
